I guess it is in that sense. But I didn't even think about that song when I heard Dani California.
came across a blog entry:
If you've been paying attention to music news the past couple days, you may have heard that the Red Hot Chili Peppers are in a bit of hot water. It is certain that their current hit single "Dani California" is undeniably a blatant rip-off of Tom Petty's hit "Mary Jane's Last Dance" from a decade or so ago.
This just in: Tom Petty owns am- G- dm- am.
Seriously, that's a bunch of bullshit. The verse part is similar, but the choruses are completely different.
Ever listened to Country Roads by John Denver? The melody in the chorus is exactly the same as that in Going Steady's Tokyo Boy. It is, however, insane to accuse a band of plagiarism simply because they use the same three chords and a similar melody.

Verse riff is nearly identical, choruses are actually pretty similar, as are the bridges, solo, lyrical theme, and melody. All they needed to do was call it "Dani California's Last Dance" and it would be the same song.

I disagree. I can grant that the verse riff is similar, but Tom Petty doesn't own those damn chords. Many of the chord progressions the pillows use can be traced to beatles songs, and most of those were used by classical and baroque composers.
Trying to say that any parts of the songs other than the verses are the same is really stretching it. The melodies are similar simply because they have the same chord progression; sometimes a certain progression just lends itself toward a melody.
The guitar playing, except for the chord riffs in the verse, is very different. The bridges are not similar, and the choruses and solos are totally different. If Frusciante is ripping anyone off in this song, it's Jimi Hendrix during the end solo.
